1. About these Terms

These Terms of Service (“Terms”) govern your use of the Quiet Velvet website, account, content and services (together, the “Services”).

By accessing or using Quiet Velvet, you agree to these Terms.

If you do not agree to these Terms, you must not use the Services.

3. Eligibility

You must be at least 18 years old to use Quiet Velvet.

By using the Services, you confirm that:

  • you can enter into a legally binding contract;

  • all information you provide is accurate and current;

  • you will comply with these Terms and applicable law.

Access may be suspended or terminated if there is a reasonable belief that you do not meet these eligibility requirements.

4. What Quiet Velvet provides

Quiet Velvet provides a private digital storytelling service that allows users to receive personalised romantic fantasy content, including story generation, continuations and selected revisions or rewrites.

The Services may include:

  • onboarding questionnaires;

  • personalised story generation;

  • continuation features;

  • structured rewrite or refinement options;

  • account storage and saved stories;

  • subscriptions, credits or one-off purchases.

Any part of the Services may be changed, improved, suspended or discontinued from time to time.

5. Nature of the content

Quiet Velvet provides fictional, generated content intended for personal entertainment.

You acknowledge and agree that:

  • stories are generated automatically or semi-automatically;

  • output may vary in style, tone, coherence or quality;

  • generated stories are fictional and should not be treated as fact, advice, therapy or professional guidance;

  • the Services are designed to provide romantic fantasy entertainment, not medical, psychological, legal or therapeutic services.

There is no guarantee that every output will meet your personal preferences or expectations.

6. Account registration and security

You may need to create an account to access some or all of the Services.

You are responsible for:

  • keeping your login credentials confidential;

  • all activity under your account;

  • providing accurate account information;

  • notifying Quiet Velvet promptly of any unauthorised access or suspected breach.

Registration may be refused, usernames reclaimed, or accounts suspended where reasonably necessary.

7. Purchases, subscriptions and credits

A. Paid access

Some features may require payment, including subscriptions, credits or one-off purchases.

Prices, billing intervals and included features will be shown at checkout or in your account.

B. Renewals

If you buy a recurring subscription, it may renew automatically unless you cancel before the renewal date.

You authorise the relevant payment provider to charge the applicable recurring fees unless and until you cancel.

C. Credits

If credits are offered:

  • credits may be used when you generate stories, continuations, rewrites or other paid outputs;

  • credits may be non-transferable;

  • unless stated otherwise, credits have no cash value.

D. Price changes

Prices may change from time to time. Where appropriate, notice will be given before a price change takes effect for future billing periods.

8. Cancellation and refunds

A. Cancelling subscriptions

You may cancel your subscription at any time through your account settings or by contacting [INSERT EMAIL ADDRESS].

Unless stated otherwise at checkout:

  • cancellation stops future renewals;

  • access continues until the end of the current paid period;

  • fees already paid are generally non-refundable except where required by law.

B. Digital content and immediate supply

Quiet Velvet supplies digital content that may be delivered immediately after purchase.

By purchasing immediate access to digital content, you request immediate performance and acknowledge that, once supply begins, any cancellation right that would otherwise apply may be lost to the extent permitted by law.

C. Faulty service or legal rights

Nothing in these Terms affects your statutory rights. If digital content is faulty, not as described, or not supplied with reasonable care and skill where applicable, you may have rights under consumer law.

9. Acceptable use

You agree not to:

  • use Quiet Velvet for any unlawful purpose;

  • misuse the Services or interfere with their operation;

  • attempt to gain unauthorised access to any system or account;

  • upload malware, harmful code or malicious content;

  • use the Services to harass, exploit or harm others;

  • use the Services to create unlawful material;

  • infringe intellectual property or privacy rights;

  • scrape, copy or extract the service at scale using bots or automated means except where expressly permitted;

  • reverse engineer, decompile or attempt to discover source code or underlying systems except where prohibited by law.

Reasonable steps may be taken to investigate suspected misuse and suspend or terminate access where appropriate.

10. User content

“User Content” means content you submit to Quiet Velvet, including prompts, onboarding responses, preferences, feedback and saved materials you upload or enter.

You retain ownership of your User Content, but grant Quiet Velvet a non-exclusive, worldwide, royalty-free licence to use, host, reproduce, adapt, process and display that content as reasonably necessary to:

  • operate the Services;

  • generate stories and continuations;

  • maintain account functionality;

  • secure, improve and support the Services;

  • comply with law and enforce these Terms.

You confirm that you have the right to submit your User Content and that doing so does not violate any law or third-party rights.

11. Generated content

Subject to your compliance with these Terms and payment of any applicable fees, you are granted a personal, non-exclusive, revocable right to use the generated stories you receive through Quiet Velvet for your own private, personal use.

Unless expressly stated otherwise, you may not:

  • resell generated content as part of a competing service;

  • use Quiet Velvet output to train competing models or services;

  • reproduce or distribute output commercially at scale;

  • imply that Quiet Velvet endorses any third-party use.

Because generated content may sometimes be similar across users or outputs, exclusivity or uniqueness is not guaranteed.

12. Intellectual property

The Services, including the website, design, branding, software, workflows and underlying systems, are owned by or licensed for use by Quiet Velvet and are protected by intellectual property laws.

Quiet Velvet and related names, logos, text, design elements and service features may not be used without permission.

These Terms do not transfer ownership of any Quiet Velvet intellectual property to you.

13. Service availability

Every effort is made to provide a reliable service, but there is no guarantee that the Services will always be available, uninterrupted, secure or error-free.

Maintenance, updates, repairs or improvements may temporarily affect availability.

14. Moderation and safety

Automated tools and human review may be used where appropriate to:

  • detect abuse or fraud;

  • enforce these Terms;

  • protect users, the business and service providers;

  • comply with legal obligations.

Content may be removed, access restricted, or accounts suspended where there is a reasonable belief that these Terms have been breached or the Services are being misused.

15. Suspension and termination

Access to Quiet Velvet may be suspended, restricted or terminated if:

  • these Terms are breached;

  • applicable fees are not paid;

  • fraud, abuse or unlawful activity is suspected;

  • continued access poses a security or legal risk;

  • suspension or termination is required by law.

You may stop using the Services at any time and may delete your account or contact hello@quietvelvet.com to request account closure.

Sections that by their nature should continue after termination will continue, including sections on payments owed, intellectual property, liability, disputes and general terms.

16. Disclaimers

To the fullest extent permitted by law:

  • the Services are provided on an “as is” and “as available” basis;

  • there is no guarantee that the Services will meet every personal expectation or produce any particular emotional, artistic or narrative outcome;

  • there is no guarantee of uninterrupted access, error-free operation, or perfectly personalised output;

  • generated content may contain errors, repetition, inconsistencies or material you do not like.

Nothing in these Terms excludes liability that cannot legally be excluded.

17. Limitation of liability

Nothing in these Terms excludes or limits liability for:

  • death or personal injury caused by negligence;

  • fraud or fraudulent misrepresentation;

  • breach of rights that cannot legally be limited;

  • any other liability that cannot legally be excluded or limited.

Subject to the above, and to the fullest extent permitted by law:

  • Quiet Velvet is not liable for indirect or consequential loss;

  • Quiet Velvet is not liable for loss of profits, business, revenue, goodwill or anticipated savings where the Services are used for business purposes;

  • Quiet Velvet is not liable for loss arising from misuse of the Services, failure to protect account credentials, or reliance on fictional generated content as if it were advice or fact.

If you are a consumer, Quiet Velvet is responsible for foreseeable loss and damage caused by breach of these Terms or failure to use reasonable care and skill, but not for loss or damage that is not foreseeable.

18. Changes to the Services or these Terms

These Terms may be updated from time to time to:

  • reflect changes in law;

  • reflect changes to the Services;

  • address security, technical or operational needs;

  • clarify practices.

The latest version will be posted on the website with the updated date. Continued use of the Services after updated Terms take effect means you agree to the revised Terms, except where law requires a different process.

19. Governing law

These Terms are governed by the law of England and Wales, unless mandatory local consumer law in your place of residence applies differently.

If you are a consumer, you may bring proceedings in the courts available to you under applicable law.
